Serikali yaridhia mkataba wa mashamba kuvunjwa
na Rodrick Mushi na Beatrice Maina, Hai
MGOGORO wa mashamba ya Silverdale na Mbono yanayomilikiwa na vyama vya ushirika vya Mamba, Uswaa na Kyeri umechukua sura mpya baada ya serikali mkoani Kilimanjaro kuridhia maombi ya wanachama ya kutaka kuvunjwa kwa mkataba wa mashamba hayo.
Maamuzi ya wanachama hao yalifikiwa jana mbele ya Mkuu wa Mkoa huo, Monica Mbega, aliyeambatana na viongozi wa mkoa, Wilaya ya Hai na Mrajisi Msaidizi wa vyama vya ushirika mkoani hapa, Kasya Kasya katika mkutano wa vyama hivyo.
Mashamba hayo yenye ukubwa wa ekari 993 yapo chini ya mwekezaji Fiona Tanzania Limited aliyeingia mkataba Januari mosi 1999 baada ya serikali kutaka mashamba hayo yatafutiwe mwekezaji.
Katika mkutano huo chini ya mwenyekiti wa muda wa vyama hivyo, Bashiri Shoo na wanachama hao walipitisha rasmi azimio la kutoutambua mkataba wa maridhiano uliosamehe kodi ya zaidi ya sh milioni 80 iliyopaswa kulipwa na mwekezaji huyo.
Wanachama hao wanamlalamikia mwekezaji huyo, Benjamin Mengi, kupitia kampuni yake ya Fiona kwamba pamoja na kuvunja mkataba lakini pia ameharibu miundombinu ya shamba sanjari na kutoendeleza zao la kahawa kama lilivyo agizo la serikali.
Kwa upande wake, Mkuu wa Mkoa Mbega, alisema serikali haina pingam
izi na maamuzi ya wanachama ambao ndio wamiliki wa mashamba hayo na kwamba aliwataka kufuata taratibu ili kuvunja mkataba huo.
Aliwataka wanachama hao kupeleka muhtasari wa mkutano huo mbele ya wakili wa vyama hivyo, Apollo Maruma, ili aweze kufuata taratibu husika za kuvunja mkataba huo unaotambulika kisheria.
“Nimekuja hapa sina jibu la moja kwa moja ndiyo maana nilitaka niwasikilize kwanza…maamuzi mnayo ninyi, taratibu zikifuatwa vyema serikali tutawaunga mkono, hatuwezi kuvumilia kuona malengo ya vyama yakikiukwa kwa makusudi,” alisema.
Alisema atapeleka maombi ya vyama hivyo katika Wizara ya Kilimo, Chakula na Ushirika kwa utekelezaji zaidi ili maamuzi ya vyama hivyo yafanyiwe utekelezaji.

In an overtly corrupt move,corrupt Moshi Advocate Apollo Maruma represented the Kyeeri, Shari and Uswa Mamba co-operative societies in order to steal the lease to Silverdale and Mbono Farms from British investors Stewart Middleton and Sarah Hermitage.
Mengi negotiated with the societies in 2000, to amend thee terms of his lease to the farms i.e., the term was reduced from 60 years to 45 and the rental paid to the co-ops was increased. The co-ops gave then written permission for the lease to be sold to the investors (although this was not required under the terms of the lease). The lease was sold to the investors and the cooperatives accepted an increase in rent form them.

In the face of this very clear assignment of the lease to the farms, advocate Maruma’s move on behalf of the co-operative societies to sue Benjamin Mengi for breach of contract and repossessing the farms from him ignoring the assignment to the investors amounts to the clear nationalisation of assets on the part of the Tanzanian government.

For the record, we take the liberty to respond to our copy of the email from the so called
Solicitor of the Supreme Court of England & Wales. With due respect, she displayed an
extreme sense of arrogance in publishing such a defamatory story against our integrity
about which she is least qualified to judge. She demonstrated the height of desperation
and recklessness.
In a nutshell, she, through Silvedale (T) Ltd, conspired to take over tracks of land on lease
to Fiona (T) Ltd without due consent by owners, poor rural villagers organised as
Cooperative Societies, our clients. The societies recovered their land for defaults in rentals
payments and poor investment etc which Fiona is challenging in court. The fraud between
Fiona and Silverdale went sour hence her desperation. Allegations of corruption are frivolous,
insulting and offensive to say the least.
The Solicitor - turned - agricultural investor is welcome to pursue her rights, if any, in court
and avoid malicious smear campaigns, against resident professionals. She should learn
to look back over her shoulders when she set foot in Tanzania again.
If Sarah has lost faith in our system of government, she should try Zimbabwe.

In this email, Maruma suggest that the investors behaved dihonestly to acquire land without the consent of the owners. He omits to refer to the lawful assignment which had the consent of the owners and payment of rent to them and the fact that they lived on the farm for four years. See documents below.
